Are electric motorcycles street legal in the United States?

The National Conference of State Legislatures (NCSL) states that "federal law only specifies the maximum speed that the e-bike can travel under motor power alone. It does not provide a maximum speed when the bicycle is being propelled by a combination of human and motor power. The Consumer Product Safety Commission has clarified that the federal law does not provide a max speed when using a combination of human and motor power, and that State traffic laws and vehicle codes remain the sole domain of states and state legislatures."

What this means is that there is no federal law banning the use of electric motorcycles on public roads in the US and the regulation of electric bikes/ motorcycles lies within state and local authorities and you should check your respective state vehicle code for reference.   • Class 1 E-Bikes: A bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle reaches the speed of 20 miles per hour.
  • Class 2 E-bikes: A bicycle equipped with a motor that may be used exclusively to propel the bicycle, and that is not capable of providing assistance when the bicycle reaches the speed of 20 miles per hour.
  • Class 3 E-bikes: A bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle reaches the speed of 28 miles per hour and is equipped with a speedometer.

Unconquered Custom electric motorcycles are categorized as Class 3 out of the factory as they come preprogrammed for 28 mph; however, each bike can be programmed post purchase to satisfy either of the class 1 or class 2 categories. The Bicycle Product Suppliers Association (BPSA) classifies electric bikes based on the top speed at which the electric bike motor assists the rider, and how much effort it takes to get the bike up to speed. Twenty-six states have now adopted this three-class system. An electric bike’s classification will determine if you can ride your electric bike on bike paths and in bike lanes, or strictly on roadways, and again these laws vary by state.

Some state laws actually specifically allow e-bike operation on facilities such as bicycle paths or greenways. Certain states, including Delaware, Iowa, and Nebraska, define electric bicycles within the existing definition of a bicycle. Therefore there is no a distinction between bicycles and an Unconquered Custom when it comes to operation on trails. Vermont specifies that motor-assisted bicycles are governed as bicycles and have the same rights and duties applicable to bicyclists. Hawaii’s law does not include restrictions on where e-bikes may operate.
